- Assessments & late payments: Assessments are billed annually and due in monthly installments. A late fee of at least $25 is charged each month a payment is late, plus interest at 18% per year. Returned checks incur a $30 fee; after two within 12 months the HOA may require future payments by certified check or money order.
- Collection steps & foreclosure: If an assessment remains unpaid after the due date, the HOA sends a demand letter (certified mail) giving at least 45 days to pay. Continued delinquency can lead to a lien on the property and eventually foreclosure (via expedited or judicial process). The HOA may also suspend use privileges or services.
- Fine schedule for violations: For curable violations (e.g., trash cans, yard maintenance), the first fine is $50, second $100, third $250, and subsequent fines $500 each. For uncurable or health/safety violations, first fine is $100, second $250, third $400, and subsequent $500. Fines cannot exceed $500 per single violation.
- Hearing process: If a homeowner requests a hearing in writing within 30 days after a Notice of Violation, the Board must hold one within 30 days. The HOA must provide an evidence packet 10 days before the hearing. The Board’s decision (including sanctions) is issued within 10 days of the hearing.
- Corrective action by HOA: For violations not cured after a Notice of Violation, the HOA may enter the property to correct the issue after written notice (certified mail). All costs are charged to the homeowner’s account. The HOA may also refer serious violations to legal counsel for injunctive relief or damages.
