This is the declaration of covenants, conditions, and restrictions for Evergreen Estates, a single-family residential subdivision in Keller, Texas. It establishes a mandatory homeowners association (HOA) for all lot owners, with assessments, architectural controls, and use restrictions to maintain the neighborhood's character.
- Assessments & fees: Every lot owner pays semi-annual assessments (due January 1 and July 1), with the initial maximum annual assessment capped at $300 per living unit. The association may levy special assessments for capital improvements with member approval, and delinquent assessments accrue interest at 10% per year and become a lien on the property.
- Architectural control: All exterior improvements, including construction, alterations, and fencing, require prior approval from the Architectural Control Committee. Fences may not exceed 6 feet in height, wire fences are prohibited, TV dishes must be no larger than 24 inches and screened from street view, and landscaping must be completed within 60 days after the house is 90% complete (including two live oak trees near front and side streets).
- Property use & occupancy: Lots are restricted to single-family detached residences only, with a maximum height of 2.5 stories and occupancy by only one family per residence. Dwellings must face the street, and no subdivision of lots is allowed.
- Pets: Dogs and cats are allowed, but no other animals, livestock, or poultry may be kept on any lot.
- Maintenance & landscaping: Owners must maintain their lots and landscaping in a neat and orderly condition, controlling weeds, trash, and unsightly growth. If an owner fails to comply after 10 days' written notice, the association may enter the property, perform the maintenance, and charge the owner, with the cost becoming a lien.
- Vehicles & storage: No house trailers, mobile homes, campers, boat trailers, or similar wheeled vehicles may be parked on a lot, except within a garage or as approved by the Architectural Control Committee. No rubbish, debris, or building materials may be stored on a lot.
- Duration & amendments: These covenants run with the land for 25 years from the recording date, automatically renewing in 10-year increments unless owners of 51% of lots agree to amend or terminate them. Amendments require written notice to all owners and recording at least one year before the change takes effect.
