Riverdance (Keller, TX) is a single-family subdivision where each lot is subject to a recorded Restrictive Covenant and Agreement between the original buyer and builder West Point Homes. This document focuses on construction disputes and warranties, not typical HOA rules. It binds current and future owners to mandatory arbitration for most disputes and includes waivers of implied warranties and mold-related liability.
- Mandatory arbitration & dispute resolution: Any dispute between the owner and builder (including contract, warranty, tort, or construction defects) must go through mediation and then binding arbitration under the Federal Arbitration Act. The arbitrator, not a court, decides arbitrability, and the loser may have to pay the other side's legal fees if litigation is started in violation.
- Warranties & builder liability: The builder gives only a written third-party limited warranty; all implied warranties (good and workmanlike construction, merchantability, fitness) are disclaimed and waived, except the implied warranty of habitability. Manufacturer warranties on equipment (AC, appliances) are assigned to the buyer, with no builder warranty on those items.
- Mold & biological impurities disclaimer: The buyer acknowledges mold or biological impurities can occur, releases the builder from all claims for damages (including personal injury) related to mold, and agrees to maintain humidity, clean regularly, and promptly repair leaks. The buyer also waives subrogation rights against the builder.
- Transferability & successors: This agreement 'runs with the land' and binds all future owners. If the property is sold or the original buyer vacates, any remaining builder warranties or duties become void, and the builder is released from all claims relating to the property.
