What Inspiration Point Estates Homeowners''s governing documents say
Inspiration Point Estates is a single-family home subdivision in Kennedale, TX, governed by a homeowners association (HOA). The rules apply to all lot owners, who are required to be members of the HOA. The subdivision has a private street, gate, and common areas maintained by the association. Every lot must have a single-family detached residence of at least 2,000 square feet, and all exterior construction is subject to Architectural Control Committee approval.
- Architectural review: All new construction, alterations, fences, and accessory structures require prior written approval from the Architectural Control Committee (ACC). Plans must be submitted; if no decision within 5 working days after compliance with restrictions, they are deemed approved. The ACC also enforces design harmony and material standards.
- Setbacks and building requirements: Dwellings must be at least 25 feet from the front property line, 10 feet from side lot lines, and at least 85% of exterior walls must be stone, masonry, brick, stucco, or glass. Minimum floor area is 2,000 square feet. Roofs must be minimum 30-year shingle or approved equivalent. Each residence must have a minimum two-car attached garage. No metal storage buildings are allowed.
- Occupancy limits: Each residence may be occupied by only one family, defined as persons related by blood, adoption, or marriage, or no more than two unrelated persons living together as a single housekeeping unit (plus household servants).
- Pets: Dogs, cats, or other household pets are allowed but cannot be bred or maintained for commercial purposes. No animals, livestock, or poultry are permitted.
- Parking and vehicle storage: No boats, trailers, mobile homes, campers, or similar wheeled vehicles may be stored nearer to the street than the front of the house; storage must be in a closed garage or within a fenced, walled area hidden from street view. Temporary storage for up to 24 hours is allowed. Vehicles carrying inflammatory or explosive cargo are prohibited.
- Landscaping and maintenance: Each lot must be landscaped with shrubs, flowers, trees, and grass, including a front-yard sprinkler system, completed within 120 days after the house is 90% complete. Owners must control weeds and maintain neat conditions. The HOA may mow and clean lots after written notice and assess a fee plus 10% interest, which becomes a lien on the lot.
- Association fees and assessments: Annual assessment is $200 per lot, payable in full by the second Thursday of January. New owners pay the remainder of the fiscal year's dues at closing. Delinquent assessments incur a $20 late fee if unpaid after 30 days, plus 10% annual interest. The HOA board sets the budget and may impose special assessments.
- Common areas and amenities: The HOA maintains the private street, street lights, entrance gate, and common area landscaping. The association carries liability insurance. The gate ensures access for the city and utilities; if the HOA fails to maintain reliable access, the city may remove the gate at the HOA's expense.
