Water's Edge Condominiums is a condominium community in Lake Dallas, TX. You own the interior of your unit (walls, floors, ceilings) plus any assigned balcony or patio. The association maintains and insures the building's common elements and common areas, funded by assessments based on your unit's floor area.
- What you own & maintain: You own your unit's interior surfaces, fixtures, and appliances. You must maintain them and any porch, balcony, or patio assigned to your unit. The association handles structural repairs and common element maintenance, unless damage is caused by your negligence.
- Leasing & rentals: Leases must be for a term of at least 60 days (no short-term or vacation rentals). All leases must be in writing and comply with board requirements. No time-sharing arrangements are allowed.
- Units & allocated interests: The community has an initial 81 units, expandable up to 161. Your share of common expenses, common element ownership, and voting power are based on your unit's proportionate floor area (see Exhibit B for exact percentages).
- Alterations & exterior changes: You need board approval before making any alteration that affects the structure, exterior appearance (including window treatments), or any system serving more than one unit. Changing assigned parking spaces also requires approval.
- Parking: Parking spaces may be assigned as limited common elements to specific units by the declarant. Any spaces not assigned within 120 days after the last unit sale come under association control, which may lease or assign them to owners.
- Assessments & liens: Annual and special assessments are based on your unit's allocated percentage. Unpaid assessments bear interest at the default rate (up to 18% per annum) and create a lien on your unit, enforceable by foreclosure.
- Use restrictions: Units are for residential use only. No commercial activity is allowed. You must keep your unit clean and free of nuisances or offensive odors.
