What Shore Haven's governing documents say
Shore Haven (Hickory Creek, TX) is a single-family subdivision, but this recorded document is not its HOA rules — it is an ancillary Declaration of License for Access. It grants the Hickory Creek Shore Haven HOA a revocable, non-exclusive right to use two private rights-of-way (VP-ROW and P-ROW) for vehicle and pedestrian access to the subdivision from Oak Drive. The document binds only the property owner who granted the license and the HOA; it does not govern day-to-day life for homeowners or renters.
- What this document is: It is a license, not a full set of covenants or HOA rules. It simply permits the HOA to use two strips of private land (VP-ROW and P-ROW) that connect the subdivision to Oak Drive, based on a prior verbal agreement since 2017.
- Access rights granted: The HOA may use the VP-ROW for vehicular and pedestrian ingress/egress to/from Oak Drive to Shorehaven Lane, and the P-ROW for pedestrian and occasional vehicular ingress/egress. The rights are non-exclusive, personal to the HOA, not assignable, and do not run with the land.
- Limitations on use: The HOA cannot put up any buildings, fixtures, or structures on the rights-of-way, cannot make commercial or public use of them, cannot allow disorderly or dangerous conduct, and cannot trim or cut any vegetation on or adjacent to them.
- Maintenance & liability: The property owner has no duty to maintain, repair, or replace the rights-of-way, and the HOA has no right to do so or to demand the owner do it. The HOA uses the rights-of-way at its own risk, and the owner is not liable for any damages or injuries to the HOA or its guests.
- Termination & changes: The owner (or any future owner of the rights-of-way) can terminate or modify this license at any time, for any reason or no reason, simply by recording a notice or modification in the Denton County records — without notice to the HOA. The HOA cannot prevent termination.
- What this document doesn't cover: It does not contain typical HOA rules — no assessments, no pet limits, no architectural review, no lease restrictions, and no fines or enforcement procedures. Separate CC&Rs or a different governing document would cover those, and this does not tell you what living in Shore Haven would require of you as a resident.
