- Violation enforcement process: The association sends an initial notice giving the owner 14 days to cure the violation. If not cured, a formal Notice of Violation is sent by certified mail, giving 30 days to cure and offering the right to request a hearing before fines are imposed.
- Fine structure: Fines start at $50 and escalate every 14 days up to $500 per violation period. There is no aggregate limit on total fines for a single violation. Fines begin on the 14th day after the Notice of Fine date.
- Right to a hearing: After receiving the Notice of Violation, the owner has 30 days to request a hearing before the Architectural Control Committee or the Board. If no written request is made within 30 days, the right to a hearing is waived.
- Corrective action by association: With board approval, the association may hire contractors to correct a violation after providing the owner an initial notice and a separate Notice of Corrective Action with an opportunity to cure or request a hearing. Costs are charged to the owner.
- Repeated violations: If an owner commits the same violation again within 6 months of a previous cure, enforcement resumes at the stage where it left off (e.g., fines may restart without additional notice).
- Referral to legal counsel: The association may refer any violation directly to legal counsel at any time, without following the full notice process, to seek injunctive relief or damages.
- Board committee voting rights: A separate resolution in this document states that board members who also serve on any association committee shall serve ex officio without voting rights on that committee.
