This is a supplemental declaration of restrictive covenants for a specific 1.152-acre parcel (the 'Property') within the Twin Lakes Estates subdivision in Double Oak, Texas. It is an ancillary document that adds extra restrictions on top of the main Twin Lakes Owners Association rulebook, and it binds the owner of that parcel. The Property is intended to be kept as open space, with only one single-family residence allowed if combined with an adjacent tract.
- Open space & building restrictions: The Property must remain open space with no structures unless the Architectural Review Committee approves. A residence may only be built if the Property is combined with the adjacent Morrison tract into one platted lot, and only one single-family home is allowed; guest quarters and other residential structures are prohibited.
- Prohibited uses & items: No temporary dwellings, boats, trailers, RVs, campers, aircraft, or vehicles carrying flammable cargo may be parked or stored. No oil drilling, mining, dumping, individual water or sewage systems, signs, fires (except outdoor cooking), or building material storage are allowed. Business or commercial activities are prohibited.
- Architectural review: Any building, fence, wall, or other improvement requires prior written approval from the Architectural Review Committee, which prioritizes preserving the open-space character. The Committee's approval does not guarantee government approvals, and the Committee is not liable for defects in approved plans.
- Assessments & liens: The Property is subject to the Twin Lakes Declaration's assessments, and unpaid assessments create a lien on the land with a power of sale. Any purchaser is jointly and severally liable for unpaid assessments at closing.
- Membership & voting: The owner automatically becomes a member of the Twin Lakes Owners Association with one vote, even if multiple people own the Property.
- Enforcement & fines: The Association or owner can enforce these covenants through legal action. The Board may impose fines up to $500 per violation after proper notice and hearing under Texas law.
- Term & amendment: This declaration runs with the land for 25 years from recording, then renews automatically for 10-year periods. It can be amended by written agreement between the owner and the Board, and it can be terminated by mutual consent.
