What High Plains's governing documents say
This is a Supplemental Amendment for High Plains at Furst Ranch, Phase 2 — it annexes a new section of a single-family home community into the existing HOA. The document primarily warns future homeowners about nearby natural hazards (wildlife, flooding) and utility easements, and requires them to indemnify the association and developer. It does not contain the full community rules (e.g., on pets, leasing, or parking).
- Annexation and applicability: Phase 2 is added to the High Plains at Furst Ranch HOA, meaning all prior CC&Rs and rules now apply to these lots, except that reserve areas labeled as 'lots' on the plat are not lots (no vote, no assessments).
- Notice of conditions & hazards: Owners acknowledge nearby conditions including manmade and natural hazards (holes, streams, flooding, alligators, snakes, coyotes, wild hogs), a community trail system, recreational facilities, and two Atmos Energy pipeline easements (recorded under Document No. 2024-95472 and No. 2024-95465) and a Lone Star Gas Company right-of-way.
- Assumption of risk & release: Each owner and occupant assumes all risk of personal injury from plants and wildlife on the property. The association and developer have no duty to control or remove wildlife and are not liable for injuries.
- Indemnification obligation: Every owner must defend, indemnify, and hold harmless the developer, association, and related parties against any claims arising from the conditions, even if caused partly by the indemnified parties' negligence.
- Easements for recreational facilities: Lots near recreational facilities (Recreational Facilities Lots) are subject to easements for errant sports balls, noise, lights, and overspray. Owners of those lots assume the risk of damage or injury and release the association and developer from liability.
- Environmental responsibility: Owners near conditions must not allow trash, fertilizers, chemicals, or petroleum products to infiltrate the property; they are fully responsible for cleanup and remediation costs.
