The covenants are recorded by the builder (MHI Partnership, Ltd.) and bind the current and future owners of each specific lot. They primarily impose a 15-year arbitration agreement and a jury trial waiver, not a typical HOA rulebook.
- Arbitration requirement: Any claim or controversy related to the purchase, construction, or repair of the home, or the property itself, must be settled by binding arbitration under the Federal Arbitration Act. This applies to the buyer and all future owners and occupants for 15 years from the closing date.
- Jury trial waiver: If any dispute goes to court, the parties waive their right to a trial by jury. This waiver is binding on all future owners and occupants.
- Term and expiration: The covenants run with the land for 15 years from the closing date, then automatically expire, except for arbitration or legal proceedings already in progress. If the builder reacquires the property, the covenants terminate immediately.
- Attorney's fees: If the seller or declarant prevails in enforcing the covenants, the losing party (including future owners) must pay the prevailing party's attorney's fees and litigation costs.
