This is a clarification amendment to the homeowners association (HOA) declarations for Fairways NW at WestRidge, a McKinney, TX subdivision (platted as Fairways North and Fairways West). It applies to lot owners in that community. The document only changes how the HOA's budget shortfalls are funded during the developer's control period; it is not the full set of community rules.
- What this document doesn't cover: This is a partial amendment, not the full declaration. It modifies only the budget-funding and borrowing provisions; all other covenants, restrictions, and rules remain in the original recorded declarations.
- Budget funding & developer shortfall guarantee: During the developer control period, the developer (D.R. Horton) is responsible for paying the difference between the association's operating expenses and the regular assessments received from non-developer owners, and will provide extra funds needed to cover actual cash outlays.
- Reimbursement as interest-free loan: Any shortfall the developer covers becomes an interest-free, ongoing working capital loan from the developer to the association. The association must repay it when targeted funds are received, and the repayment obligation survives the end of the developer control period unless the developer formally forgives it in writing.
- Borrowing rules amendment: The declaration's section on the association's right to borrow money is amended to exclude loans made between the developer and the association during the development period.
