Inwood Hills is a standard single-family homeowner association (HOA) in McKinney, TX. This document is a collection of ancillary policies on covenant enforcement, fines, and assessment collection — not the full set of community rules. It explains the procedures and penalties the HOA may use to enforce the main covenants, conditions, and restrictions (CC&Rs) that apply to each lot.
- Covenant enforcement process: The HOA may send a courtesy notice, then a formal Notice of Violation by verified mail, describing the violation and giving a cure period. The homeowner has the right to request a hearing before the board (held within 30 days). If a cure is possible and the violation does not pose a threat to safety, the owner gets a reasonable opportunity to correct it before a fine can be imposed.
- Fines and penalties: Fines are up to $500 per initial violation, up to $500 for a second violation, and up to $500 per month for ongoing violations. Repeat offenders may face double fines. Categories include single-family use, nuisances, architectural violations, parking/vehicle violations, pet/animal violations, landscaping, rules/regulations violations, and all other violations. Fines may be levied as special assessments and secured by the HOA's assessment lien.
- Assessment collection process: After a notice of late payment, the HOA may send a Notice of Default no sooner than 75 days past the due date. An attorney demand letter may be sent at 110 days, and legal action including lien filing at 120 days. Homeowners have the right to request a payment plan and a board hearing. Unpaid assessments can lead to suspension of common area privileges (after 45 days delinquent) and eventually foreclosure.
- Definitions and scope: This policy applies to all lot owners and covers enforcement of the Declaration of Covenants, Conditions and Restrictions (the 'Declaration'), Bylaws, and rules. It does not cover assessment collection procedures (the Collection Policy is separate). The policy says it is not a prerequisite to the Association's ability to pursue legal remedies except as required by the Texas Property Code.
