Hardin Village is a single-family home planned community in McKinney, TX, governed by a homeowners association (HOA). All lot owners are mandatory members and must pay assessments. The rules cover residential use, maintenance, leasing, pets, vehicles, and architectural changes.
- What you own & maintain: You own your lot and single-family residence (max 2 stories). You must maintain the exterior and landscaping, keep grass under 4 inches, and not let vegetation become overgrown. The HOA maintains common areas (if any) but is not obligated to provide amenities.
- Leasing & rentals: Leases must have an initial term of at least 12 months and cover the entire residence. Tenants must sign an acknowledgment of the rules, and owners must provide a copy of the governing documents. Owners are responsible for tenant violations and fines.
- Pets: No more than 3 household pets per lot. Pets must be kept clean and waste must be picked up. Animals for commercial purposes or food are prohibited.
- Parking & vehicles: No parking of commercial vehicles, boats, trailers, campers, trucks over 1 ton, or semi-trucks on streets or driveways; they must be kept in garages. Inoperable vehicles are not allowed. Temporary parking for loading/unloading or emergencies is allowed. The HOA can tow violators.
- Architectural review: Any exterior changes, construction, or painting (except same color) require prior approval from the Architectural Control Committee (ACC). Plans must be submitted in duplicate; approval expires if construction doesn't start within a specified time or finish within 1 year. The ACC can charge fees and deny unusual or bizarre designs.
- Assessments & fees: Annual assessments start at $450 per lot (2016) and can increase up to 20% per year without membership vote. Special assessments require 51% member approval. Late fees ($25/month) and interest apply; unpaid assessments become a lien on the property. Transfer fees may apply at sale (up to the annual assessment).
- Enforcement & fines: The HOA can issue fines, enter the lot to correct violations at owner expense, levy special individual assessments, suspend common area use, and file lawsuits. Owners get at least one notice and 10 days to cure before fines accrue.
- Prohibited uses & restrictions: No commercial use except home offices. No short-term rentals (under 12 months). No clotheslines visible from street. No fences over 8 feet; wood fences minimum 6 feet. No satellite dishes visible from street (subject to FCC rules). No signs except real estate and security signs. No woodpiles visible from street.
