What Summit Pointe Estates's governing documents say
Summit Pointe Estates (McKinney, TX) is a homeowners association (HOA). This document is the HOA's Assessment Collection Policy — a partial rulebook that details how delinquent assessments are collected, but does not contain the full CC&Rs, community rules, or usage restrictions.
- Late charges & interest: Regular assessments are due on the first of the month. Late fees and interest apply if not paid by the due date; the policy outlines how they are calculated and assessed.
- Collection procedures: The HOA will send a series of notices (friendly reminder, 30-day letter, 45-day intent to file lien) and may order a title search, file a lien, or refer the account to an attorney if not paid. Owners have a right to dispute the balance within 30 days.
- Payment application order: Any payment received is applied to the oldest charges first in this order: delinquent assessments, current assessments, attorney fees, other attorney costs, fines, then other obligations.
- Acceleration of assessments: Special assessments payable in installments may be accelerated (the full balance becomes due) only after at least 15 days' notice of default, and the Association has no duty to reinstate after acceleration.
- Suspension of amenities: The Board may suspend use of common area amenities by an owner or tenant whose account is delinquent for at least 30 days.
- Liability for collection costs: The defaulting owner is liable for all reasonable collection costs, including title reports, certified mail, long distance calls, filing fees, and attorney's fees.
- What this document doesn't cover: This is only the Assessment Collection Policy. It does not include the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs), community use rules, architectural guidelines, pet restrictions, or other typical HOA rules. Those would be in separate governing documents.
