- Fine amounts & schedule: For standard violations: 1st fine $50, 2nd $100, 3rd $200, 4th+ $400. For unapproved ACC modifications: 1st $100, 2nd $200, 3rd $400, 4th+ $500. For uncurable violations or those threatening health/safety: fine up to $2,000. Fines can be imposed daily with no aggregate limit. Repeated violations after cure may trigger doubling of fines.
- Notice & hearing rights: The association sends a courtesy notice, then a formal Notice of Violation (by certified and first-class mail) allowing at least 14 days to cure. The owner may request a hearing before the Board within 30 days of the notice. The hearing must be scheduled at least 10 days after notice, and the owner can request one postponement up to 10 days.
- Corrective action (self-help): If a violation is not cured within 14 days after a Notice of Violation, the association may hire contractors to correct it without further notice, and charge the cost to the owner's account.
- Payment & consequences: Unpaid fines may become a lien on the property. Payment does not waive the violation; the owner must still correct it. Owners are responsible for fines even if caused by tenants.
