The Painted Tree Residential Community Association, Inc. is a homeowners' association (HOA) in Plano, TX governed by these Bylaws. This document outlines the internal governance structure for the association, including membership rights, board elections, meetings, and assessment authority. It does not contain specific rules for residents such as pet policies, leasing restrictions, or property standards — those are likely in the Declaration and separate Rules & Regulations.
- Membership & voting: Each lot owner is a Member with voting rights as specified in the Declaration. Quorum for member meetings is 10% of total votes. Votes may be cast in person or by proxy, and electronic voting and written consent are allowed.
- Board of Directors: The Board governs the association; initially appointed by Declarant, later elected by Members. After Declarant control ends, there are five Directors serving staggered two-year terms. Directors may serve unlimited successive terms and are not compensated.
- Meetings: Annual member meetings are held in January (or as set by Board) with at least 10 days' notice. Board meetings are open to Members with 72 hours' notice (email and posting). Special meetings can be called by the President, Board majority, or 10% of Members.
- Assessments & budget: The Board determines and levies assessments, adopts annual budgets, and may increase assessments under certain conditions. The Board may adopt a Fine Policy for violations and set fees for estoppel certificates.
- Records & inspections: The Association must keep a Minute Book and membership list, open to Members per the Records Policy and Act. Financial records must be kept in accordance with GAAP.
