This is the amended and restated declaration of covenants, conditions, and restrictions for Vineyards of Fairview, a single-family residential HOA in McKinney, Texas. It binds all lot owners and governs what you can build, how you use your property, and what the homeowners association can require of you.
- Residential use & leasing: Lots are for single-family residential use only. You may lease your home for a minimum term of six months, but no apartments, hotels, or short-term rentals are allowed.
- Architectural review: You must get prior written approval from the Architectural Committee before constructing, altering, or removing any improvement that changes the exterior appearance, including color, landscaping, fences, and outbuildings. The committee has 14 days to act on complete applications, and approvals lapse if construction doesn't start within a specified time.
- Construction standards: Homes must be at least 3,000 square feet of enclosed living space, use at least 75% brick, stone, or approved masonry, and have a minimum 25-year roofing material. Wood shingles are prohibited, and windows must be clear, non-reflective glass.
- Fences & garages: Fences cannot exceed 4 feet in height and must be approved; wood stockade, chain link, and wire fences are prohibited. Carports are not allowed, and each home must have an attached garage for at least two cars, kept closed except when entering or exiting.
- Vehicles & parking: Passenger vehicles, motorcycles, and scooters cannot be parked outside your garage for more than 12 hours. Boats, trailers, RVs, and trucks (other than passenger trucks) cannot be parked on your lot, and no junk vehicles or equipment may remain visible.
- Pets & animals: No dangerous animals are allowed, and pets must be kept on a leash when outside. Owners must clean up pet waste immediately.
- Assessments & liens: The association can levy regular and special assessments, which are equal for all lots and become a personal debt of the owner. Unpaid assessments accrue interest (up to 2% per month) and can lead to a lien and foreclosure on your property.
- Fines & enforcement: The board can fine owners for violations, with a minimum fine of $25 per day. You have the right to request a hearing within 30 days of a fine notice, and you may have a reasonable time to cure the violation before the fine is imposed.
