What Crane- Woodland Oaks Ph II's governing documents say
This is a supplemental rules and policies document for Crane- Woodland Oaks Ph II, a standard single-family homeowners association (HOA) in Pantego, TX. It updates and adds to the existing governing documents to comply with Texas legislation passed during the 2021 session. The document binds all homeowners and residents within the subdivision and covers procedural policies, not the full set of community restrictions.
- Covenant violation hearings: Owners can request a hearing within 30 days of a violation notice. The association must provide documents it will use; both sides present facts, and the board decides. Audio recording is allowed with advance notice.
- Architectural review: An architectural reviewer cannot be a board member or household member. Denials must be sent by certified mail, hand delivery, or electronic means with detailed basis. Owners have 30 days to request a hearing; the board must schedule it at least 10 days out and may affirm, modify, or reverse the decision.
- Board meeting notice requirements: Regular board meetings must be noticed to owners 10 to 60 days in advance, including date, time, place, and general subjects. If posted or emailed, notice is at least 144 hours before. Certain actions (fines, foreclosures, assessment increases, etc.) cannot be voted on in closed session.
- Contract bid procedures: For service contracts costing over $50,000, the association must solicit bids or proposals from at least three vendors, allowing at least seven days for responses. If only one bid is received, the board may proceed.
- Pool fencing and security devices: All pool enclosures and security fencing require architectural approval. Pool enclosures must be black, meet safety laws, and the association cannot unreasonably withhold approval. Front-yard security fencing is discouraged but if installed, must be black wrought iron or metal with specific dimensions (picket spacing 3–4", post spacing 8' OC, height between 3–4 feet).
- Delinquent assessment notice and credit reporting: Before reporting a delinquency to a credit agency, the association must provide a 45-day notice and a detailed report of charges. It cannot report amounts under dispute. A separate 30-business-day notice is required before reporting. Payments must be applied first to delinquent assessments, then current assessments, then certain fees.
- Religious display policy: Owners or residents may display religious items on their property if sincerely believed, unless the item threatens health/safety, violates law, or is patently offensive. Items cannot be placed on common property or public fixtures. State law (Texas Property Code §202.018) overrides any conflicting restrictions.
- Statutory notice and document availability: The association must make current governing documents available online to members and file a management certificate with the county and the Texas Real Estate Commission within 7 days of recording or amendment.
