What Ivygreen's governing documents say
Ivygreen is a single-family home subdivision in Pantego, TX, governed by a set of deed restrictions (covenants) that run with the land. These rules apply to all homeowners and residents, covering what you can build, how you maintain your property, and basic neighborhood standards.
- Permitted use & buildings: Lots are for residential use only, with one single-family dwelling (max two stories) and a private garage (max 3 cars). The air-conditioned floor area must be at least 2,200 square feet, and no lot can be subdivided below 10,000 square feet. Pre-existing or pre-constructed homes are not allowed, and temporary structures, mobile homes, trailers, and campers are prohibited as residences.
- Architectural review: Any exterior construction, alteration, fence, or other structure must be approved in writing by the Architectural Committee (appointed by the Declarant, for now). Plans must be submitted showing design, location, and relation to surroundings. The committee has 30 days to act; if no response, approval is deemed given.
- Exterior standards & materials: At least 80% of the exterior walls (ground floor) must be masonry, stone, or similar. Roofs must be covered with minimum 225-lb composition shingles (tile, slate, wood permitted) and have a pitch of at least 10-in-12 unless special approval is granted (limited to 20% of lots). Boundary fences must be wrought iron, stockade, masonry, wood, or hedge; max 8 feet high; no chain link. Garage doors must not face the street unless located on the rear 50% of the lot.
- Lawn & property maintenance: Lawns must be mowed regularly to keep a neat appearance. If a lot owner fails to maintain it, Declarant (or association) may mow and bill the owner, with a lien for payment. Trash and garbage must be kept in covered containers and removed regularly.
- Vehicles, boats & trailers: No vehicles (including boats, trailers, mobile homes, campers) may be parked on lots or driveways overnight unless stored inside a garage. Vehicles carrying explosive or flammable cargo are prohibited. No commercial vehicles are allowed overnight.
- Pets & animals: No animals or livestock may be raised or kept, except that dogs, cats, or other household pets may be kept if they are not bred or maintained for commercial purposes.
- Other restrictions: No antennas or towers for radio purposes; no noxious or offensive activity or nuisance. No building or fence within utility easements. Signs are limited to 'For Sale' or builder signs, except a single Ivygreen Addition identification sign.
- Duration & amendments: These covenants run with the land until January 1, 2007, and automatically renew every 10 years thereafter. They can be changed by a 2/3 majority vote of lot owners (one vote per lot), recorded before the change takes effect.
