This document is a policy adopted by the Sunset Hills Addition Homeowners Association Inc. (a single-family HOA in Pantego, TX) that governs how delinquent assessments are collected. - Assessment due dates & delinquency: Regular assessments are due on the first calendar day of the month charged (or as the Board designates). Any unpaid assessment becomes delinquent immediately after the due date, and remains delinquent until paid in full.
- Late fees & interest: If full payment is not received by the late date (as set in governing documents, typically 5:00 PM on a specified date), the Association may charge a late fee per month and/or interest at the highest rate allowed by Texas usury laws. A $30 fee applies for returned checks (NSF/stop payment).
- Collection costs: The defaulting owner is liable for all collection costs, including title reports, certified mail, court costs, and attorney's fees incurred by the Association.
- Payment plans: The Association must offer a payment plan to delinquent owners with a minimum term of 3 months and a maximum term of 18 months. The Board determines the actual term and may charge reasonable administrative costs and interest.
- Collection procedures: The Association may delegate collection to a manager, attorney, or debt collector. Steps include sending delinquency notices, ordering title searches, recording a lien, and eventually forwarding accounts to an attorney. Payment in full after a lien is recorded triggers a release of lien (owner may prepay recording costs).
- Suspension of privileges: If an owner's account is delinquent for at least 30 days, the Board may suspend the owner's (or tenant's) use of common area amenities.
- What this document doesn't cover: This is only an assessment collection policy. It does not cover ordinary HOA rules such as architectural restrictions, use of property, pets, parking, leasing limits, or community amenities beyond the suspension provision.
