It binds all lot owners to a strict set of architectural standards and allows the association to maintain common areas and also the entire lawn (front, side, and rear) of each lot. Key financial obligations include annual assessments, special assessments, and potential fines for violations.
- Lot use & occupancy: Each lot may only be used for a single-family residence. No garage or outbuilding may be used as a living quarter. Construction must be completed within 12 months of commencement.
- Architectural review: All exterior construction, modifications, fences, landscaping, and even paint colors must be approved by the Architectural Control Committee (ACC). Plans must be submitted and approved before work begins.
- Design standards: Exteriors must be 100% brick, stone, or stucco. Roofs must be 320 lb composition shingles in 'Blended Weatherwood' with ridge enhancers. Minimum roof pitch 8/12, minimum plate height 10 ft. No solar panels visible from the street. Driveways must be concrete, brick, or stone. All garages must be enclosed for at least 2 cars, with recessed wooden doors.
- Yard maintenance: The Association is responsible for mowing, edging, and fertilizing the entire lawn (front, side, and rear) of each lot. Homeowners must still install and maintain landscaping per standards, including automatic sprinklers, St. Augustine sod, trees, and landscape beds with brick/concrete borders within 90 days of flooring installation.
- Fences & walls: Side and rear fences may be up to 6 ft tall; fences facing the street up to 4 ft (unless board approves taller). Fences must be double-sided board-on-board cedar on metal posts. Retaining walls max 3 ft unless incorporated into foundation, set back 1 ft from property lines.
- Assessments & fees: The annual assessment starts at $1,600 per lot (prorated if closing mid-year). Assessments are due quarterly (Jan 1, Apr 1, Jul 1, Oct 1). Annual increases up to 10% without member vote; larger increases or special assessments over one quarter's assessment require 3/4 member approval. Unpaid assessments accrue 18% annual interest and create a lien on the lot.
- Enforcement: The Association can impose fines, suspend voting rights and common area use for rule violations. For design violations, the Association has the right to enter the lot after notice and abate the violation. The Board may also suspend rights for nonpayment of assessments.
- Insurance & liability: The Association may carry property and liability insurance on common areas. The Declarant and Association are not liable for security failures or personal property losses. The indemnity clause holds the City harmless for private street maintenance.
