This is a set of amendments to the Declaration of Covenants, Conditions and Restrictions for Mobberly Farms, a single-family HOA in Pilot Point, Texas. The amendments update rules for homeowners, including fencing, lightning rods, architectural review, leasing, and association procedures. They are part of the governing rules for anyone buying or living in this community.
- Leasing & rentals: The HOA can require owners who lease their home to provide tenant contact info and lease term. Also, if a home has an FHA, VA, or USDA loan, certain rental restrictions in the Declaration won't apply to that home.
- Architectural review: After the developer's control ends, no current board member, their spouse, or household member can serve on the Architectural Review Committee (ARC). Denials must be sent by certified mail, hand delivery, or electronic delivery, and owners have 30 days to request a hearing. Variances granted are permanent and can't be revoked by future reviewers.
- Fencing & structures: Fencing on corner lots or facing streets must be cedar wood or better, board-on-board with steel posts, with the smooth side facing out. Interior lot fences can be 6 feet high, board-to-board, cedar, with metal posts, but no cap if not visible from the street. Swimming pool enclosures must be 6 feet or less, black, transparent mesh in metal frames. Security fencing in front yards must be open ornamental metal or wrought iron, no chain link or razor wire, and no higher than 6 feet.
- Lightning rods: Owners may install lightning rods only if they meet NFPA 780, UL 96A, and LPI-175 standards, are installed by a licensed contractor, and are kept functional. Owners release the association from liability related to lightning rods.
- Resale certificates & fees: The association can charge up to $375 for a resale certificate and up to $75 for an update. The certificate must be delivered within 5 days after the second request, and the association can require payment before issuing it.
- Assessments & collections: The association can report delinquent owners to credit agencies only if the delinquency isn't disputed, the owner gets 30 business days' notice, and has a chance to set up a payment plan. No fee can be charged for the credit reporting itself.
- Association operations: The association must solicit bids for contracts over $50,000. Owners get a hearing packet at least 10 days before hearings, and can get a 15-day postponement if not provided. The association has no law enforcement function.
