Amelia Court is a single-family patio home community in Plano, Texas governed by a homeowners association. This Amended and Restated Declaration sets the rules for all lot owners, covering land use, assessments, architectural controls, and common area maintenance.
- Occupancy & use: Each lot is for single-family residential use only. Occupancy is limited to one family (persons related by blood, adoption, or marriage) or no more than two unrelated persons living together as a single housekeeping unit, plus household staff. Only one detached single-family home per lot, max two stories.
- Assessments & fees: The Association levies annual assessments, special assessments for capital improvements, and special individual assessments. The annual assessment can be increased up to 25% per year by the Board; any increase above 25% or for a fourth consecutive year requires 52% member approval. Assessments are secured by a lien on the lot.
- Architectural controls: No exterior improvements or modifications may begin until plans are submitted to and approved in writing by the Board of Directors. Plans must be submitted at least 30 days before construction. The Board may also adopt Design Guidelines. Failure to approve or disapprove within 30 days results in automatic approval.
- Parking & vehicles: Boats, RVs, trailers, campers, and similar vehicles cannot be stored in driveways or front yards, and can only be parked on streets or driveways for up to 72 consecutive hours for loading/unloading/cleaning. Trucks over 1 ton and commercial vehicles with painted signage are restricted. No inoperative vehicles. Visitor vehicles up to 14 days. Prohibited vehicles include off-road vehicles and trailers.
- Pets: No more than four pets (dogs and/or cats) per lot. Pets must be confined to the owner's rear yard within a secure fence or inside the home. Owners must control noise and clean up waste. Animals cannot be raised or bred for commercial purposes.
- Signs & decorations: One 'For Sale' sign (max 2x3 feet, stake-mounted, no more than 3 feet high) is allowed. Political signs allowed 30 days before election, removed within 8 days after, max 3 signs per lot, each max 2x3 feet. Holiday decorations permitted for reasonable time frames. Security signs allowed up to 2x3 feet. Non-complying signs may be removed by the Association.
- Enforcement & liens: The Association or any owner may enforce the declaration through legal proceedings. Unpaid assessments become a lien on the lot, and the Association may foreclose using a power of sale as under Texas Property Code. Failure to enforce does not waive future enforcement rights.
