What River Bend West Plano C's governing documents say
This is a set of governing documents for River Bend West, a single-family residential subdivision (with some duplex lots) in Plano, TX, created by a developer in 1980. The primary document is a Declaration of Restrictions, Conditions and Covenants that applies to all lots, with additional provisions for 'Lake Lots' that have a separate association for a waterway. Separate Party Wall Agreements exist for specific lots. The rules bind all homeowners and occupants.
- What you own & maintain: You own your lot and the house on it. The Declaration requires you to maintain your lot (including trees, grass, and structures) and prohibits anything that causes an unclean or disorderly appearance. The waterway for Lake Lots is maintained by a special association.
- Single-family use: Each lot must be used for one single-family residence, except certain lots designated for duplexes (each unit occupied by a single family). Family is defined as persons related by blood, marriage, or adoption within three degrees, plus domestic servants and temporary guests.
- Minimum dwelling size: Each residence must have a minimum floor area as specified in an exhibit to the Declaration (e.g., for most lots, 1,700 sq ft; duplex units must have at least 1,200 sq ft per side). The ground floor of a multi-story home must be at least 1,300 sq ft.
- Architectural review: All plans for new construction, additions, or alterations must be approved by an Architectural Committee before work begins. The Committee can disapprove based on design, materials, color, harmony with surroundings, or any other reason in its sole discretion. Plans are deemed approved if not acted on within 30 days.
- Fences & landscaping: Fences require Committee approval and cannot be wire or woven fence visible from the street. They must not extend nearer the street than the front building line. Hedges along front or side lot lines cannot exceed 3 ft high except trees. All lots must be kept well-landscaped.
- Parking & vehicles: Motor vehicles must be parked in garages or carports. Overnight parking of trucks over 3/4 ton is prohibited on streets. Inoperable vehicles, boats, and trailers must be stored inside a garage or carport. No major vehicle repairs in the open.
- Lake Lot association & assessments: Lake Lot owners automatically belong to an association that maintains the waterway. The association can levy annual assessments (up to $200 initially), special assessments for capital improvements, and individual assessments for damage caused by owners. Assessments are a lien on the lot.
- Party walls: Separate Party Wall Agreements exist for certain lots, recorded in 1997 and 1995 (DOC 204674, 204684, 204685). These agreements define shared ownership and maintenance responsibilities for common walls between adjoining properties.
