What Glen Heather Homeowners Association, Inc.'s governing documents say
This is the Amended & Restated Bylaws of the Glen Heather Homeowners Association, Inc., a single-family home HOA in Plano, TX (71 lots). The bylaws govern the association's internal operations, board structure, meetings, voting, and assessments. They bind all lot owners, who automatically become members upon ownership.
- Governance structure: The association is governed by a Board of Directors initially of 9 members, each serving 1-2 year terms in specific roles (President, President-Elect, Treasurer, and directors for Landscaping, Communications, Social Activities, Safety, Planning/Zoning). The board may later elect an odd number less than 9. The board has broad powers to administer covenants, enforce rules, maintain common properties, and levy assessments.
- Membership & voting: Three classes: Class A (all other owners) gets 1 vote per lot; Class B (builders constructing for sale) is non-voting and converts to Class A on 10th anniversary or when certain vote thresholds are met; Class C (developer, Sheppard Farm Venture) gets 6 votes per lot owned. Quorum for certain actions is 60% of votes of each class; for other actions, 30%. Proxies allowed.
- Assessments & fees: Annual association dues are due January 1 and July 1. Payments are late after 30 days, incurring a $25 late fee every 30 days. Special assessments may be levied. The board may adjust monthly assessments and borrow funds as needed.
- Use of common properties: Owners and tenants may use common properties (as defined in the recorded plat) for their intended purposes. Owners must comply strictly with the Declaration and these bylaws.
- Amendments: During the first 10 years, Declarant may amend with 60% vote of members. After 10 years, amendments require 75% vote of members or board resolution with 75% owner consent.
- What this document doesn't cover: These bylaws do not cover architectural controls, pet restrictions, leasing terms (e.g., minimum lease duration), or age restrictions. Those likely appear in the separate Declaration of Covenants, Conditions, and Restrictions.
