What Shaddock Creek Estates's governing documents say
This is a single amendment to the homeowners association (HOA) rules for Shaddock Creek Estates, a single-family home community in Frisco, Texas. It updates the leasing rules for homeowners, not renters directly. The amendment adds a new section to the community's governing declaration, so it's a partial document that focuses only on rental restrictions.
- Leasing & rentals: Homeowners can only lease their entire home, not part of it. Leases must be in writing, last at least 12 months, and require board approval. Short-term rentals (under 365 days), vacation rentals, and transient housing are banned. New owners must wait 12 months after buying before leasing, unless they get a hardship exemption from the board.
- Tenant screening & background checks: Before leasing, owners must provide the board with the lease agreement, tenant contact info, and a criminal background report for each adult occupant. The HOA can reject tenants with certain felony convictions (e.g., violent crimes, sex crimes, drug offenses, theft). Owners must also give tenants a copy of the HOA rules.
- Enforcement & penalties: Leases that don't follow these rules are void, and the HOA can fine the owner, evict occupants, or sue. The HOA can also charge an administrative fee for processing lease requests and may set additional leasing policies.
- What this document doesn't cover: This is only the sixth amendment to the HOA's declaration, so it doesn't cover other community rules like architectural guidelines, maintenance duties, or assessments. Those are in the original declaration and other amendments.
