What Lakeview Ranch Homeowner's governing documents say
Lakeview Ranch is a standard single-family homeowners' association in Providence Village, TX. The documents provided are the Association's Bylaws and two amendments, which define the governance structure, meeting procedures, and board composition. They bind all homeowners and residents, but the full set of rules (including property use restrictions and assessments) is in a separate Declaration not included here.
- Board of Directors: The Board has 5 directors (amended from 3), each serving staggered 2-year terms initially. Directors are elected by members at annual meetings; they can be removed with or without cause by a majority vote of members. The Board manages the association's affairs, enforces rules, and can levy fines as special assessments.
- Member Meetings & Voting: Annual meetings are held within 90 days after the fiscal year ends. A quorum for a meeting requires members representing 50.1% of all votes (amended from original 60%). Each lot has one vote; if multiple owners, only one vote is cast by a majority-in-interest. Voting rights can be suspended for unpaid assessments or rule violations (up to 60 days). Proxies are allowed for up to 11 months (max 3 years).
- Assessments & Enforcement: Details of assessments are in the separate Declaration. The board can suspend voting rights for nonpayment and can enforce rules through fines (enforceable as special assessments) and legal action. Members may be personally liable for damages from violations.
- Architectural Control Committee: If the members approve, the Board appoints an Architectural Control Committee of at least 3 persons to review and approve exterior changes as outlined in the Declaration.
- Open Meetings & Records: Board meetings are open to all members, but members cannot participate unless authorized. Members can inspect association records (membership register, financial books, minutes) at reasonable times for a purpose related to their interest. Directors have absolute inspection rights.
- What this document doesn't cover: These Bylaws and amendments do not include the full Declaration of Covenants, Conditions, and Restrictions, which contains the actual property use restrictions (e.g., architectural standards, pet limits, leasing rules, maintenance obligations, assessment amounts). Those rules are incorporated by reference but not provided.
