What Enclaves's governing documents say
This is a standard single-family residential HOA for the Enclaves at Creekwood subdivision in Frisco, TX. It applies to all lot owners, residents, and tenants, and it sets rules for property use, architecture, leasing, pets, parking, and more.
- Use restrictions: Each lot is limited to one single-family detached residence (max 3 stories). Occupation is limited to persons living together as a single housekeeping unit; for unrelated persons, no more than two per bedroom.
- Leasing & rentals: No more than 10% of residences may be leased at any time. Initial lease term must be at least one year; the entire residence must be leased. Owners must provide tenants with rules, and tenants must carry renter's insurance. Subleasing is prohibited. Lots sold during Declarant Control Period may be perpetually excluded from the leasing cap if the original buyer remains owner.
- Architectural review: All exterior modifications (structures, landscaping, paint, etc.) require prior written approval from the Architectural Control Committee. Fines up to $1,000 for violations or work without approval. Declarant controls the process until 120 days after the Declarant Control Period ends.
- Pets: Maximum three household pets per lot. Aggressive or vicious breeds (such as pit bulls or Rottweilers) are prohibited. Pets must be leashed when outside, registered, and properly vaccinated. Owners must clean up waste. Fines up to $1,000 for attacks or violations.
- Parking & vehicles: Each lot limited to four vehicles. Street parking is for short-term only (max 24 hours). Recreational vehicles, boats, trailers, and inoperable vehicles cannot be parked on streets. Commercial vehicles with logos are prohibited unless garaged. Pickup trucks and SUVs without commercial lettering are allowed.
- Fences & landscaping: Fences must be brick, wood, or wrought iron (no vinyl or chain link). Maximum height 6 feet. Landscaping must be installed per Design Guidelines; sod, trees, and shrubs required. Maintenance of landscaping is owner's responsibility.
- Signs: Political signs allowed 90 days before election and must be removed within 10 days after. One real estate sign (max 5 sq ft) allowed when property is for sale or rent. Other signs generally prohibited without approval.
- Assessments & fees: Regular assessments are levied per lot to fund common area maintenance and operations. Special assessments may be levied for unexpected expenses. Fines for rule violations can be up to $1,000 per violation.
