What Buckingham Homeowners As's governing documents say
This is an amendment to the Lakes of Buckingham (Richardson, TX) HOA declaration — it does not contain the full community rules. It adds a perpetual easement over each lot's side yard for the benefit of the adjacent lot, allowing access for construction, repair, or maintenance of that neighbor's home. This binds all lot owners and is relevant to anyone buying, owning, or building in this subdivision.
- Easement for adjacent lot access: The side yard of each lot (5–10 ft from the side boundary) is burdened with an easement in favor of the adjacent lot for access, ingress/egress, and construction/maintenance of the benefited lot's residence. The exact area is determined by the as-built location of the residence walls.
- Restrictions on burdened lot owner: The owner of the burdened lot cannot install permanent improvements (e.g., air conditioning, pool, spa, plumbing) or erect structures that interfere with the easement, without prior architectural committee approval. They may use the easement for other purposes as long as it does not interfere with the benefited lot's use.
- Liability and indemnity: The benefited lot owner and Declarant are not liable for damage to landscaping or improvements within the easement area caused by reasonably necessary construction, though they must use reasonable care. The burdened lot owner must indemnify the Declarant for any accidents or damage from Declarant's use of the easement (except Declarant must replace damaged sod/irrigation). The benefited lot owner must indemnify the burdened lot owner for accidents/damage arising from the benefited lot's use of the easement.
- What this document doesn't cover: This amendment only addresses construction easements. It does not cover other typical HOA rules such as architectural review, pet restrictions, leasing, parking, maintenance obligations, assessments, or amenities.
