This is an ancillary Amenity Access Agreement between the Century Farms HOA (CF HOA, Inc.) and the owner of a separate build-to-rent community called the Cottages. It allows residents (Permittees) of the Cottages to use the Century Farms amenities in exchange for a fee. The document only covers amenity access rights and related obligations; it is not a full set of HOA or condo rules.
- Amenity access & eligible users: Residents (Permittees) of the Cottages—a 290-home build-to-rent community—are permitted to use all existing and future amenities of Century Farms, including swimming pools, clubhouse, tennis courts, dog runs, pavilions, splash pad, playscapes, fire pit, hammocks, event lawn, trails, and fishing ponds, subject to the Association's rules.
- Amenity access fee: The initial Amenity Access Fee is $0 per Permittee per year. The Association may increase the fee annually, but by no more than 10% year over year, and any increase must be commercially reasonable and tied to the Association's budget.
- Term & renewal: The agreement has an initial term of 5 years and automatically renews for successive 5-year terms unless either party provides written notice of non-renewal at least 180 days before the end of the current term.
- Maintenance obligation of Cottages owner: The Cottages owner (ONML) must maintain the Cottages in good condition and repair, comparable to similar properties in the area, including structural integrity, pavement, lighting, signage, and landscaping.
- What this document doesn't cover: This document does not contain rules for pets, leasing, parking, architectural standards, assessments, or any other typical HOA restrictions. It only governs amenity access between the HOA and the build-to-rent community owner. Residents should refer to their own lease or community rules for other obligations.
