Lindsey Estates is a single-family detached home community in Richardson, TX, governed by a homeowners association (HOA). This document is a second amendment that adds new architectural controls (Article VI) and expanded property-use restrictions (Article VII) to the original deed restrictions. It binds all lot owners, meaning anyone who buys a home here must follow these rules. Note that this is only a partial amendment—it does not contain the full set of HOA covenants or rules about assessments, leasing, or membership obligations.
- Architectural review: Most exterior changes (buildings, fences, landscaping, pools, outbuildings, etc.) require prior written approval from the Architectural Control Authority (ACA). The ACA has 30 days to review a complete application; if it fails to respond in writing within 30 days, the request is deemed approved. The ACA may charge a reasonable review fee, and its decisions are based on aesthetic compatibility and property values. Approved improvements must be completed within one year.
- Fences & party walls: Every backyard must be enclosed with a perimeter fence. Fences must be wood, brick, stone, or masonry (no chain-link or metal unless not visible from streets/common areas) and between 6 and 8 feet high (Association fencing may be as low as 4 feet). Shared fences are treated as party walls, with equal cost-sharing for repairs unless one owner caused the damage. Owners cannot add a second parallel fence alongside a common fence.
- Parking & vehicles: Only passenger vehicles (cars, motorcycles, vans, pickups under 1 ton capacity) may be parked in driveways or garages, and they must be in operating condition. Commercial vehicles over 1 ton cannot park overnight. Boats, trailers, RVs, and other recreational vehicles are generally prohibited unless stored in an enclosed garage or fully screened. No abandoned or inoperable vehicles may be kept outside an enclosed garage.
- Pets: No more than two domesticated pets are allowed per lot. Farm animals (cows, horses, pigs, chickens, etc.) are prohibited, and pets must be kept on leash and cleaned up after. The board can require removal of any pet that is noisy, dangerous, or a nuisance.
- Home businesses: Dwellings are for single-family residential use only. A home business is allowed only if it is clearly incidental to the residential use, does not create noise, odor, traffic, or parking issues, and does not involve customers/clients coming to the home. The board has sole discretion to determine if a business meets these criteria.
- Signs & advertising: Only limited signs are allowed: one 'for sale/rent' sign (max 2'x3'), an open-house sign during showings, a garage sale sign (also 2'x3') during the sale, and political signs (can be erected 60 days before an election and must be removed within 7 days after). All other signs need prior ACA approval, and the association may remove non-compliant signs.
- Other property standards: Detached outbuildings are limited to 225 sq ft and 8 feet in height, and must be in a fenced backyard. Above-ground pools are prohibited. Exterior antennas and satellite dishes are restricted (small dishes under 1 meter allowed if not visible from the street). No clotheslines, exterior window treatments like aluminum foil, or burning (except in fireplaces and outdoor cooking/fire pits). Landscaping must be maintained, and removal of native trees requires ACA approval.
