The governing document is a Declaration of Covenants, Conditions and Restrictions, as amended, that establishes the homeowners association, common elements, and rules for use, maintenance, and assessments. This document binds all property owners.
- What you own & maintain: Each Unit (townhouse or single-family residence) is owned in fee simple; owners are responsible for maintenance and repair of their Unit, including interior fixtures and any private utilities. The Association maintains the Common Elements (land, pools, clubhouse, utilities) funded by assessments. Single-family residence owners are not required to pay for townhouse repairs.
- Use & occupancy: All Units must be used as single-family residences. Leasing is allowed only with a written lease that requires the lessee to comply with the declaration and bylaws. No lease term minimum is stated. The declarant retains the right to rent units before initial sale.
- Architectural review: No exterior additions, alterations, or new structures may be made without prior written approval from the Board of Directors or an Architectural Control Committee. Plans showing design, materials, and location must be submitted; approval is deemed given if not decided within 30 days.
- Assessments & liens: Common expenses are assessed per unit and constitute a lien on the unit if unpaid, superior to all liens except taxes and first mortgages. The Association may foreclose like a mortgage. Delinquent owners must pay costs, interest, and attorney's fees.
- Party walls (Townhouses): Walls between townhouses are party walls. Repair costs are shared proportionally by the owners using the wall. If an owner negligently damages a party wall, they bear the full cost. Disputes are resolved by three arbitrators.
- Pets & nuisances: Household pets (dogs, cats) are allowed but must not cause unreasonable disturbance. No animals, livestock, or poultry may be raised or bred. Noxious or offensive activities, excessive lighting, or loudspeakers that annoy other owners are prohibited.
- Parking & vehicles: No campers, boats, or motor homes may be stored on any portion of the Project except in an enclosed garage. Garages, streets, carports, and driveways shall be used exclusively for automobiles.
- Reconstruction & insurance: If up to two-thirds of townhouses and common elements are damaged, insurance proceeds (and if insufficient, a deficiency assessment) will be used for reconstruction. If more than two-thirds are destroyed, owners may elect not to rebuild. Single-family residence owners are not assessed for townhouse repairs.
