What Lowery Acres's governing documents say
Lowery Acres is a subdivision of single-family detached lots in Richland Hills (Tarrant County, TX), governed by deed restrictions that run with the land. These covenants bind all lot owners and are enforceable by any owner in the subdivision. The restrictions cover land use, building standards, and occupancy, but do not create a homeowners association or common areas.
- Land use & dwellings: Lots are restricted to single-family residential use only. Only one private residence, garage, servant house, and necessary outbuildings are allowed per lot. Occupancy is limited to one family, plus servants living on the premises.
- Minimum floor area: Each residence must have a minimum floor area of at least 800 square feet.
- Exterior materials: At least 25% of total outside wall area (excluding gables and areas above first-floor windows) must be brick, stone, brick-veneer, stone veneer, or other masonry materials.
- Height & garages: Structures may be frame but not exceed two stories in height. Each residence must include a private garage for no more than two cars.
- Signs: No signs are allowed on any lot except one professional sign of not more than 5 square feet advertising the property for sale or rent, plus larger builder signs during construction.
- Duration & amendment: These covenants remain in effect until January 22, 2017, and automatically extend for successive ten-year periods unless changed by a vote of a majority of lot owners.
- What this document doesn't cover: This document does not create an HOA, set any fees or assessments, regulate leasing terms beyond occupancy, restrict pets, or address parking of vehicles, recreational items, or landscaping.
