What Aero Valley Property Owners Association's governing documents say
Aero Valley is a residential airport community near Roanoke, TX — homeowners own lots with private hangars and share a runway. Rules are enforced by an Architectural Control Committee (ACC) that delegates authority to a Property Owners Association (POA) board. This declaration consolidates restrictions for residential, commercial, and non-commercial T-hangar properties.
- Airport governance & assessments: The ACC (seven members elected by property owners) or its delegated POA board sets and collects monthly fees for common-area maintenance (including taxiways). Funds must be held in an insured interest-bearing account.
- Architectural review: Any improvement (structure, fence, sign) needs written ACC approval first. If the ACC doesn't respond within 30 days, approval is automatic. Plans must show quality, design harmony, and compliance with restrictions.
- Residential use restrictions (Aero Valley Estates): Lots are for single-family detached homes only (max two stories) plus a private garage and aircraft hangar. Minimum dwelling size: 1,500 sq ft ground floor. Hangar minimum: 1,500 sq ft, must be integrated with the home. No mobile homes, tents, or temporary dwellings. Commercial repair or disassembly outside the hangar is banned.
- Setbacks & height: Front setback: 35 ft; interior side: 10 ft (5 ft in rear third of lot); rear: 1 ft. Corner lots: 35 ft from street side. Structures over 25 ft, rear fences over 6 ft, front-yard fences, and woven wire fences (except chain link) need ACC approval.
- Pets & nuisance: Dogs, cats, and domestic animals are allowed but must not create offensive odors, noise, or nuisance. No commercial animal operations. Pigs and swine are specifically prohibited.
- Signs, fires, & storage: Signs are generally prohibited except small directional, info, or 'for sale' signs. Outdoor fires are banned. Flammable fuel storage is prohibited (except in commercial areas with restrictions). No dumping of trash; property must be kept clean.
- Commercial & non‑commercial T‑hangar areas: Outside the residential lots, commercial box hangar and non‑commercial T‑hangar properties must keep all repairs inside the hangar, no fuel storage, no open‑air parts storage, and no unattended vehicles in the taxiway. Signs are prohibited except small directional or info signs.
- Duration & amendment: Restrictions run with the land for 30 years from original date (1969‑1970) and auto‑renew every 10 years. They can be amended by a majority of record owners at any time (per Texas court interpretation). Violations can be enforced by any group of 10% of owners.
