This is a Declaration of Restrictions and Easements for Cross Roads at Terrell Phase 1B, a commercial development in Terrell, TX. It governs the rights and obligations of pad owners (commercial lot holders) and the developer, not residential homeowners. It covers construction standards, signage, common area maintenance, cost sharing, insurance, and default remedies.
- What this document covers: It applies to commercial pad owners in Phase 1B (lots 1 and 2 of Block 6 and Block 7). Each pad owner is responsible for building and maintaining their own improvements on their pad, subject to developer approval.
- Construction & approval: Before any construction, pad owners must submit detailed plans (grading, utilities, elevations, landscaping, lighting) to the developer for approval. Construction must use first-class materials and comply with zoning laws, and all improvements must match approved plans.
- Signage: All signage requires prior written approval from the developer and must conform to a master signage plan (Exhibit C). Limits include: one sign for inline tenants, two for end caps, three for freestanding tenants. Monument signs limited to 6x6 feet.
- Common area maintenance & costs: The developer maintains common areas (parking, drive aisles, landscaping, detention facilities). Pad owners pay a proportional share of Common Area Maintenance Charges and a Maintenance Fee for detention facilities, based on pad size. Payments are monthly in advance.
- Insurance & environmental: Pad owners must maintain insurance as per Exhibit E. They cannot use hazardous materials except in ordinary compliance with environmental laws, and must indemnify other parties for any environmental claims.
- Defaults & remedies: If a pad owner defaults on obligations (e.g., failure to pay, violations), after 30 days' notice and cure period, the developer or other pad owners may seek legal relief, cure the default themselves, and charge the defaulting owner costs plus 5% late fee and interest.
- What this document doesn't cover: This is a commercial pad declaration and does not contain residential rules (e.g., no pet limits, no age restrictions, no lease terms for residential units). It does not apply to individual homeowners, only to commercial property owners and their tenants.
