This is a First Amendment to the Declaration of Covenants, Conditions and Restrictions for Creekside at Austin Waters, a homeowners association (HOA) for single-family lots in The Colony, Texas. It amends only one provision of the original declaration, adding a $1,000 one-time working capital payment from buyers. This document is not the full rulebook for the community.
- One-time working capital payment: Upon buying a lot, the purchaser must pay $1,000 to the HOA's working capital fund, in addition to annual assessments. The Board may later change this amount by a recorded resolution.
- Exemptions from the payment: No working capital contribution is required for foreclosure sales, transfers to or from the Association, or voluntary transfers to a co-owner, spouse, child, or parent. The Board's decision on whether an exemption applies is final and binding.
- What this document doesn't cover: This is only a piece of the governing documents and does not contain the full HOA restrictions, assessment rules, architectural guidelines, or other covenants. It solely changes Section 4.10 about the working capital fee.
