Box 62 Midlothian, TX 76065 [email protected] Fencing Any fence or wall shall be constructed of br ick, masonry, stone, steel, iron work, wood or other material as approved by the ACC as specified in the CC&R’s.

A privacy fence shall be defined as a fence that is opaque or having such qualities as to constitute an effective visual barrier in the de termination of the ACC. A privacy fence shall not include construction site barriers or la ndscape treatments. A wrought iron fence of open design shall not be considered a privacy fence.

• Chain link fences are not allowed.

• Fences on creek lots or pond lots are to be ope n iron work style fences so as to not limit the view of the natural beauty from the streets and other lots.

• No fences are permitted in the front of the home.

• No side or rear fence or wall shall be more than eight (8) feet high.

• No hedge in excess of three (3) feet in hei ght and no wall or fence shall be erected or maintained nearer to the front Lot line than the front of the home.

• All fences shall be constructed so that the sides of the fence cont aining the structural supports face inward and are not visible from any street.

• All wood privacy fence posts shall be made of steel. Wooden posts are not allowed.

• All wood fences shall be stained on both sides within 60 days of installation.

Chain link fences may be approved for use as a dog run or animal containment area only by a variance granted by the ACC. In such case the fence must be concealed from view from any street or adjacent lot and lo cated behind a privacy fence.

• All wood fences shall be stained on both si des within 60 days of construction using a penetrating oil stain in a shade of brown color to prevent weathering.

• Stains used on any fence in public view must meet specifications as described below. All remaining fences on lot and visible in public view must be stained the same color and maintained by the property owner.

• The owner of the fence is responsible for st aining and maintaining both sides of their fence unless a mutual agreement with adjacent property owners has been made. Examples Wood Defender® Semi-t ransparent Stain Color Examples: Sierra, Wrangler Ready Seal® Semi-transparent Stain Color Example: Medium Brown Outbuildings and Structures All types of detached structures should be submitted for ACC review and approval.

The following criteria will be used by the ACC in consideration of temporary or portable outbuildings to be placed on lots. All improvements require ACC submittal and approval prior to placement on a lot.

8.1 Small Building for Lawn Equipment • One small building for lawn equipment is exempted from being placed behind a privacy fence per the Covena nts and Deed Restrictions.

8.2 Large Portable Storage Buildings • A large portable storage building is defined as a building that exceeds 64 square feet • The maximum size of a large portable storage building shall be 12’ x 16’.

• Structures larger than 12’ x 16’ shall be considered a permanent structure and shall comply with the Deed Restrictions regarding new construction.

• A large portable storage building shall be located in the back yard behind a privacy fence that will screen the view of the building from any street and adjacent lot.

• A large portable storage building shall not ex ceed 12’ in height at the ridge line of the roof • A large portable storage building may be placed on a concrete slab foundation or blocks and it may be placed or moved as a complete unit.

• A greenhouse must be portable and must not be built on a concrete slab foundation • A greenhouse shall not exceed 8’ in he ight at the ridge line of the roof • A greenhouse shall be painted to match the color of the house if not behind a privacy fence • Greenhouses larger than 64 square feet or that do not match this definition are considered a large portable building and sh all conform to the guidelines for a large portable building 8.7 Gazebos • A gazebo, as exempted from being behind a privacy fence , is defined as a building not to exceed 144 square feet (e.g. 12’ x 12’) • The gazebo shall be portable and must not be built on a concrete slab foundation
