Tree Policy Authorization: Article VI Section 6.5 paragraph 3 and Article VI Section 6.06 of the General Covenants.
Policy: The Architectural Control Committee (ACC), with the approval of the Quail Ridge II Homeowners Association Board, implements these policies to clarify and further expand the policies and exceptions outlined in Article VI Section 6.06 of the General Covenants and Restrictions.
Trees: In accordance with Article VI Section 6.05 paragraph 3 of the QRE II Covenants, “owner must install a front yard underground irrigation system and plant at least two 4-inch caliper or better trees in the front yard. Article VI Section 6.06: “No tree having a diameter of three (3) inches or more [measured from a point two (2) feet above ground level] shall be removed from any Lot unless such removal is in conformity with approved landscaping plans and specifications submitted pursuant to the provisions of Section 6.05.”
For optional compliance to the above paragraph, the lot owner must have in their front yard, at least: a) one tree having a total caliper of at least 12 inches in diameter, b) a multi-trunk tree with a total cumulative caliper (measuring each individual truck) of at least 12 inches in diameter, or c) multiple trees whose total cumulative caliper is at least 12 inches in diameter. Owners shall not remove any tree(s) without ACC approval. Enforcement: Members violating this policy will be notified by the ACC and/or HOA Board for immediate compliance. The Lot owner will have no action against the ACC, the Board, the Homeowners Association (HOA) or any individual acting on their behalf.
