What Desert Views's governing documents say
Desert Views, Unit 2, is a single-family subdivision in Apache Junction, AZ, subject to a groundwater replenishment covenant. This document, filed by the original developer, requires each parcel owner to pay an annual groundwater replenishment assessment to the Central Arizona Groundwater Replenishment District (CAWCD). It is not a standard homeowners association rulebook — it only addresses water supply obligations.
- Groundwater replenishment assessment: Each parcel owner must pay an annual Replenishment Assessment based on the parcel's water use, as set by CAWCD. The assessment funds groundwater replenishment and is levied each calendar year.
- Lien and personal obligation: The assessment, plus interest and penalties, is a continuing lien on the parcel and a personal debt of the owner at the time it came due. CAWCD can enforce collection under state law (A.R.S. §§ 48-3778, 48-3782).
- Amendments: The declaration can be changed only with written agreement from CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total property area, or by amendment of state law.
- Binding effect: The covenant runs with the land, binding all current and future owners. Accepting a deed means agreeing to these terms.
- What this document doesn't cover: This document does not cover typical HOA rules: no pet limits, no architectural review, no leasing restrictions, no common areas, or community amenities. It solely addresses the groundwater replenishment assessment and lien.
