Sunrise R.V. Resort is a recreational-vehicle community in Pinal County, AZ, where you own a lot and place a travel trailer (RV, park model, etc.) for permanent living or camping. The rules, enforced by the S.R.V. Resort Homeowners' Association, govern how you use your lot, the common areas, and what you can build or park. This second amendment replaces the original declaration and binds all owners.
- Permitted use & occupancy: Lots are for recreational campsites or permanent living quarters via travel trailers. Only one travel trailer and two vehicles (cars, motorcycles, etc.) may be parked per lot; one additional trailer may be parked for 24-hour loading/unloading. No commercial or gainful activity on any lot, except Declarant may use lots for sales offices. Leasing to a Single Family (defined as related group or up to three unrelated persons) is allowed, but lessees may use common areas only during lease term.
- Travel trailers & vehicles: Only one travel trailer (motor home, park model, RV, or Board-designated vehicle) per lot; tent-type folding trailers and mobile homes not designated as RVs are excluded. No parking on common area or roads except designated spaces. No motorcycles on walkways or sidewalks.
- Improvements & alterations: No building, fence, wall, awning, or other improvement may be built, installed, or altered without prior written Board approval. The Board can reject plans for aesthetic or other reasons. All changes, including exterior colors and materials, need approval. The Board may establish a procedure for applications.
- Leasing rules: A lot may be rented or leased only to a Single Family and only as an entire lot. The owner must give the Board prior written notice of the lessee's names, family members, and lease term, and comply with any additional Board rules. During the lease term, the owner forfeits common-area use, which transfers to the tenant.
- Pets: No animals, birds, or livestock other than two generally recognized house or yard pets per lot. Pets must be kept on a leash when off the lot. No pet structures visible from neighboring property. The Board may decide on nuisances or exceptions for indoor pets (birds, fish).
- Assessments & fees: Each lot owner (except Declarant) must pay annual assessments set by the Board, plus special assessments for capital improvements (approved by 2/3 vote of members). Assessments are a lien on the lot and bear 18% interest if delinquent. The Board may impose fees for common-area use and may charge for maintenance or violations.
- Common areas & maintenance: Common areas (tracts A–G, including golf course, tennis courts, pools) are owned by the Association for shared use. The Association maintains them and can set rules. Owners have an easement of enjoyment but cannot store personal property there. The Association may also enter lots for landscaping or drainage maintenance and charge the owner.
