What Apache Hills's governing documents say
Apache Hills is a single-family residential subdivision in Apache Junction, AZ, governed by Covenants, Conditions, and Restrictions (CC&Rs). These rules apply to all lot owners and occupants, focusing on property use, building standards, and maintenance. No homeowners association currently exists; one will be formed when all lots are sold.
- Land use & permitted structures: Each lot is restricted to one single-family dwelling only – no mobile homes, apartments, businesses (except home offices), or multi-family structures. A guest house of up to 1,200 sq ft is allowed. All dwellings must be at least 2,000 sq ft of finished living area (excluding garages, unheated storage). Maximum building height is 2 stories or 25 feet. Construction must be completed within 1 year of start.
- Exterior materials & appearance: Exterior walls must be masonry (concrete slump block, stone, adobe, brick, stucco, wood, or high-grade manufactured wood siding). No corrugated or galvanized metal siding. All buildings must be painted in earthtone colors. Exterior lighting must be shielded so no direct light is visible from other lots; no dusk-to-dawn or vapor lights. Generators must be muffled to not be heard on neighboring lots.
- Lot setbacks & subdivision: No structure (except fences) can be closer than 60 feet from any property line or 100 feet from the primary road. No fences or obstructions in utility easements. Lots can be subdivided, but no resulting lot may be smaller than 20 acres.
- Vehicles & storage: Non-operative or disassembled vehicles, trailers, boats must be stored inside a fully closed building. Off-road vehicles (ATVs, motorcycles, go-karts) may not be operated repetitiously on the property or roads but are allowed for ingress/egress; all such vehicles must have proper mufflers. No storage of garbage except in covered containers; no accumulation of trash or hazardous waste.
- Animals: Horses, chickens, domestic pets, and animals for 4-H or FFA projects are permitted. Commercial ranching or farming is not allowed. Pigs are prohibited.
- Roads & easements: The declarant will construct primary ingress/egress roads as bladed dirt. Owner may construct roads within their own lot. A 20-foot utility easement exists along each lot perimeter for ingress, egress, and utilities. Primary roads have separate 40- or 50-foot easements.
- Amendment & duration: These restrictions run until the end of calendar year 2050 and then automatically renew for 10-year periods unless 75% of owners (one vote per tract) vote to terminate. Amendments also require 75% owner approval. The declaration may be terminated early by 75% vote. The homeowners association will be formed when 100% of lots are sold.
- What this document doesn't cover: The CC&Rs do not mention any homeowners association dues, assessments, or architectural review committee. Leasing/rental restrictions are absent. There is no provision for common area maintenance beyond road obligations.
