What Apache Dream Townhomes's governing documents say
This is a supplemental declaration that imposes a groundwater replenishment covenant on lots in Apache Dream Townhomes in Apache Junction, AZ. It requires each parcel to pay an annual Replenishment Assessment to the Central Arizona Groundwater Replenishment District (CAWCD) based on the parcel's excess groundwater use. The assessment is a continuing lien on the property and a personal obligation of the owner. This document does not contain the community's main HOA or condominium rules.
- Replenishment assessment & lien: Each parcel is subject to an annual Replenishment Assessment levied by CAWCD based on the Parcel Replenishment Obligation (excess groundwater use). If unpaid, the assessment becomes a lien on the parcel, and CAWCD may charge interest, costs, and penalties under Arizona law.
- Binding effect & running with land: The declaration binds all current and future owners of any interest in the property. By accepting a deed, each owner agrees to the covenants, which run with the land.
- Amendments: This declaration can be modified or revoked only with the written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property, or by changes in applicable law.
- What this document doesn't cover: This declaration does not contain typical HOA or condominium rules such as pet limits, leasing restrictions, architectural review, parking, or common area maintenance. Those would be in a separate set of governing documents.
