What Landmarke's governing documents say
Landmarke is a single-family residential planned community in Pinal County, Arizona. This Declaration of Covenants, Conditions, and Restrictions (CC&Rs) governs all lots and common areas, binding owners, residents, and tenants. The association maintains common areas, enforces rules, and levies assessments.
- Leasing & rentals: Leases must be for at least six consecutive months (182 days). Written leases are required, and owners must provide tenant information and a crime-free lease addendum. Owners are responsible for tenant compliance with all project documents.
- Pets & animals: Only a reasonable number of domestic house or yard pets are allowed, not for commercial purposes. Pets must not be a nuisance (e.g., excessive noise). Structures for pets must not be visible from neighboring property. The board decides what is reasonable.
- Parking & vehicles: Vehicles must fit within size limits (1 ton capacity, 96" height/width, 250" length). Parking is allowed only in garages or on paved driveways. RVs, boats, and trailers must be stored in garages or fenced areas not visible from neighboring property. Inoperable vehicles are prohibited outdoors.
- Architectural review: All exterior improvements (landscaping, structures, solar panels, antennas, etc.) require prior written approval from the Design Review Committee. The committee sets design guidelines and may charge fees. Appeals of decisions go to the board.
- Landscaping & maintenance: Owners must landscape public yards within 90 days of acquiring a lot with a dwelling, and private yards within 180 days, per approved plans. Owners must maintain their lot, keep it free of weeds and debris, and replace dead trees visible from neighboring property.
- Assessments & fees: The association levies regular assessments (amounts not specified in this document), special assessments, enforcement assessments, and benefited property assessments. Assessments are liens on the lot if unpaid. The board sets due dates and maximum annual increases.
- Dispute resolution: Disputes between owners and the association must go through a multi-step process: notice of claim, mediation, and if unresolved, binding arbitration. Arbitration follows specific rules and costs are shared unless otherwise awarded.
