This document is a water district membership covenant for Stagecoach Trails, a residential subdivision in Arizona City, AZ. It binds all property owners to pay fees to the Central Arizona Groundwater Replenishment District (CAWCD) to secure a certified water supply. It is not a standard HOA or condominium rulebook.
- Water replenishment fees: Replenishment Assessment: Each parcel is subject to an annual Replenishment Assessment based on the Parcel Replenishment Obligation, set by CAWCD. Nonpayment results in interest, costs, penalties, and a lien on the parcel.
- Water replenishment fees: Activation Fee: An Activation Fee must be paid to CAWCD before a public report authorizing sale or lease of subdivided lands. The fee equals a per-unit fee set by CAWCD multiplied by the total number of housing units in the owner's portion of the property.
- Water replenishment fees: Replenishment Reserve Fee: A Replenishment Reserve Fee applies to Category 1 member land, equal to twice the Replenishment Reserve Charge multiplied by the total projected annual excess groundwater demand. It must be paid before a public report, or long-term storage credits may be assigned instead.
- Lien & personal obligation for nonpayment: All fees (Replenishment Assessment, Activation Fee, Replenishment Reserve Fee) constitute a continuing lien on the parcel and are a personal obligation of the owner at the time the fee came due.
- Amendment requires 67% owner approval: This declaration may be modified, amended, or revoked only by written agreement of CAWCD, the Arizona Department of Water Resources, and the owners of 67% of the total area of the property, or by statutory changes.
- What this document doesn't cover: This document does not address typical community rules such as pet restrictions, leasing terms, architectural guidelines, parking, or maintenance of common areas. It solely concerns groundwater replenishment obligations.
