Garden Trails is a standard single-family home HOA in Avondale, AZ. The rules apply to all lot owners, their tenants, and guests. The association maintains common areas (Tracts A–Q) and enforces covenants to protect property values. Key restrictions cover residential use, building size (max two stories, detached single-family home with 1–3 car garage), parking, pets, leasing (minimum 30 days), and exterior alterations (architectural committee approval required).
- Residential use & home businesses: Lots are for single-family residential use only. Home businesses are allowed if they comply with municipal ordinances. No commercial activity, no temporary structures as residences.
- Building & exterior changes: All new construction, additions, or exterior alterations (including color changes, landscaping, fences) require prior written approval from the Architectural Committee. If no decision within 60 days, approval is deemed granted. Buildings must be detached single-family homes, max two stories, with a 1–3 car garage.
- Parking & vehicles: Vehicles must be parked in garages or driveways. No overnight street parking. Prohibited on lots: trucks over 1 ton, RVs, boats, commercial vehicles, and inoperable vehicles (unless stored in an approved area). Guest vehicles may park on a lot for up to 7 days per 6 months. No vehicle repairs except emergencies.
- Leasing & rentals: Leases must be in writing, for the entire residence and lot, with a minimum term of 30 days. All leases are subject to the Declaration.
- Animals: No livestock or poultry. Common household pets (dogs, cats, etc.) are allowed in numbers determined reasonable by the Architectural Committee, but not for commercial purposes. Pets must be kept on a leash or in a fenced yard. No pet structures visible from neighboring property.
- Signs & antennas: No signs visible from neighboring property without prior approval, except: one for-sale sign (max 30x24 inches), builder/developer signs, and required legal signs. Satellite dishes (≤1 meter) must be placed to minimize visibility; larger dishes require Architectural Committee approval.
- Assessments & fees: Annual assessments (max $720 initially, increasing yearly by up to 10% or CPI). Special assessments require 2/3 member vote. Late payments incur 10% interest or $15 late fee. A transfer fee (set by Board) and a one-time reserve payment equal to 2 months' assessments are due from the first purchaser after construction.
- Enforcement & fines: The Board can fine owners for violations, after a written warning and 10-day cure period. Fines become a lien on the lot. The Association can also tow violating vehicles at owner's expense.
