What Westland 25's governing documents say
Westland 25 is a small, single-family home HOA in the Carefree/Scottsdale area (Arizona) with 12 lots. This Declaration of Covenants, Conditions and Restrictions governs the use, appearance, and maintenance of all lots, binding all owners. It sets strict architectural standards, limits on pets and vehicles, and establishes an association with assessment and enforcement powers.
- Architectural review & design standards: All exterior changes require prior written approval from the Architectural Committee. Minimum dwelling size is 3,000 sq ft (excluding garage, patios, etc.). Approved architectural styles are Santa Fe, Spanish Territorial, Spanish Colonial, Mediterranean, or Santa Barbara. At least a three-car garage with automatic openers is required. Roofing must be clay or sand cast tile; no wood or composite shingles. Garage doors must not face the street unless a variance is granted.
- Pets: No more than three (3) household pets (cats, dogs, etc.) per lot. Animals may not be bred or kept for commercial purposes. Dogs must not roam onto other lots, and owners must take steps to keep pets quiet.
- Vehicles & parking: Cars, vans, pick-up trucks (1 ton or less, pick-up style only), and motorcycles should be parked inside the garage; up to two vehicles may be parked on the driveway. No vehicle may be parked on streets or common areas for more than four hours. Mobile homes, RVs, trailers, boats, and recreational vehicles are prohibited unless approved by the Architectural Committee. Major vehicle repairs must be done in an enclosed garage; abandoned or junked vehicles must be stored inside.
- Assessments & fees: Initial regular assessment shall not exceed $2,000 per year per lot, payable quarterly. Annual increases are capped at the higher of 10% or the CPI change, unless 51% of owners approve a larger increase. Special assessments require majority vote. Maintenance assessments may be levied for cleanup or repairs. Assessments are a lien on the lot, subordinate to first mortgages. Late payments incur a $25 late fee plus interest (12% or prime+2%).
- Use & occupancy restrictions: All lots are designated for single-family residential use only. No trade, business, or commercial activity is permitted, with limited exceptions for home-based businesses that are not detectable from outside. No hospitals, sanitariums, group homes, or timeshares (occupancy in periods less than 30 days) are allowed. No lot may be further subdivided.
- Fences, walls & landscaping: Fences must be of concrete block or concrete block with wrought iron, with stucco finish. Rear and side fences may be up to 7 ft tall; front and side-lot-line fences may not exceed 3 ft. Boundary fences between lots are shared equally in cost. Front yard landscaping must be completed within 90 days of substantial dwelling completion, including at least two trees (36-inch box, 8 caliper inches total). All landscaping plans require Architectural Committee approval.
- Building completion & construction: Construction of a dwelling must be completed within 12 months of starting (with exceptions for Acts of God, strikes, etc.). During construction, the lot must be kept clean, and a portable trash container is required.
