What Acacia Lofts's governing documents say
Acacia Lofts is a condominium community in Casa Grande, AZ. You own the interior of your unit (walls, floors, ceilings) and a share of the common elements, which the homeowners' association maintains. This document is the full set of rules binding all unit owners.
- What you own & maintain: You own your unit from the interior finished surfaces inward; structural elements and exterior are common or limited common elements. You must maintain your unit and any limited common elements (e.g., balcony, patio). The association maintains all common elements and common areas.
- Architectural review: No exterior alteration (painting, construction, landscaping changes) may be done without prior written approval from the Architectural Committee. Submit detailed plans; if no decision within 45 days, approval is deemed given. A fee and deposit may be required.
- Use restrictions: Units are for residential use only by a 'Single Family' (related persons or up to three unrelated persons). No trade or business allowed except home occupations that are not detectable from outside and comply with zoning. No further subdivision of units.
- Animals: No animals, livestock, or poultry of any kind may be raised, bred, or kept on any residential unit. (The association may adopt rules on animals, but the declaration itself contains this outright ban.)
- Assessments & fees: Annual assessments are levied equally per unit. The board can increase them up to 20% per year without a membership vote; larger increases require a majority of members. Special assessments require 67% approval. A transfer fee is charged to new owners.
- Fines & enforcement: The association can fine owners for violations (e.g., $50/day for unauthorized signs). After notice and a hearing, fines become a lien on the unit. The board may suspend voting rights and use of recreational amenities for delinquent assessments.
- Insurance: The association maintains master property insurance on common elements, general liability coverage (at least $1,000,000), and directors & officers insurance. Insurance proceeds are paid to the association for repairs. Owners may need their own coverage for personal property.
