- Uses permitted and prohibited: The pad cannot be used as a fast-food restaurant selling primarily hamburgers and cheeseburgers. It cannot be subdivided or leased to more than one single user, occupant, or tenant.
- Building development: Maximum building floor area is 5,200 square feet. Only a single building may be constructed. Architectural design must conform to the shopping center's design, and site plans, elevations, grading/drainage plans must be approved in writing by the seller.
- Signage: All signage requires prior written approval from the seller and must comply with governmental regulations and the sign criteria in the RAGE. A specific shared sign is to be shared with Pad B, with Buyer paying pro rata share of costs.
- Common area maintenance: Buyer is responsible for maintenance, insurance, and lighting of common area on the subject property, but seller may revoke this right with 30 days' notice. While self-maintaining, Buyer pays only for services actually provided by seller (e.g., insurance, lighting, landscape). Pro rata share is based on 5,200 sq ft numerator.
- Enforcement: Restrictions are enforceable by seller or any consenting party under the RAGE via injunction or specific performance. Prevailing party in enforcement action recovers reasonable attorneys' fees. If seller unreasonably withholds approval, buyer's sole remedy is specific performance (not damages).
