Silver Mesa Apartments is a 96-unit affordable rental community in Casa Grande, AZ, governed by a Low-Income Housing Tax Credit (LIHTC) agreement. This document binds the owner — not residents — to rent a minimum percentage of units to households earning at or below specific income limits (30%, 50%, 60% of Area Median Income) through at least 2039. Residents must income-qualify and recertify annually.
- Affordability & income limits: At least 28.13% of units (27 units) must be rented to households earning ≤60% of AMI, 61.46% (59 units) to ≤50% AMI, and 10.42% (10 units) to ≤30% AMI. Residents must provide income documentation annually; if income later exceeds 140% of the limit, the unit may be treated as market-rate only after a comparable unit becomes available.
- Lease & rental terms: All units must be rented as residential housing on a continuous basis—no short-term or transient rentals. Leases must include immediate termination for income misrepresentation or failure to recertify. Commercial leases are prohibited except on an insubstantial portion of the property.
- Tenant protections: Low-income tenants cannot be evicted except for good cause. The owner must accept Section 8 vouchers. After a foreclosure or deed-in-lieu, existing tenants cannot be evicted or face rent increases beyond what Section 42 allows for three years.
