Dhi-Kachina Apartments (Casa Grande, AZ) is a 96-unit affordable multifamily rental community governed by a Declaration of Covenants, Conditions, and Restrictions (CCRs) that binds the owner/landlord to state housing program rules through January 1, 2034. These rules are designed to ensure the property remains affordable for low-income households, and they include strict income and rent limits, tenant protections, and an age restriction requiring at least one occupant per unit to be 55 or older.
- Income & rent limits: Six units (floating) are designated State-Assisted Units: three 2-bedroom units for households at or below 50% of area median income (AMI) with rents capped at the lesser of Low HOME Rent or the LIHTC rent limit, and three 1-bedroom units for households at or below 60% of AMI with rents capped at the lesser of High HOME Rent or the LIHTC rent limit. All other units are market-rate but still subject to the 55+ age restriction.
- Lease term & renewals: Leases for State-Assisted Units must be in writing for a term of at least 12 months (or another term by mutual written agreement). Tenancy may be terminated only for serious lease violations, applicable law violations, or other good cause, with at least 30 days' written notice.
- Tenant protections: Prohibited lease terms include waiving the tenant's right to sue, admitting guilt, allowing the owner to take personal property without court action, or excusing owner negligence. Tenants cannot waive notice of lawsuit, jury trial, right to appeal, or be charged attorney fees if they win. Eviction without cause is prohibited.
- Age restriction (55+): All 96 units must be occupied by at least one individual 55 years of age or older. The project is designated as housing for older persons, consistent with the Housing for Older Persons Act.
- Non-discrimination & fair housing: The owner must not discriminate on basis of race, color, religion, sex, disability, familial status, or national origin. Section 8 voucher holders cannot be denied occupancy solely because of their voucher status. Affirmative marketing procedures apply.
- Landlord obligations: The owner must maintain the project in decent, safe, and sanitary condition, comply with federal physical standards, keep records, submit annual certifications, and permit inspections by the Arizona Department of Housing. The owner cannot discriminate, use the property for religious purposes, or demolish/substantially alter units during the affordability period.
